ISDS damages awards often involve substantial sums, consisting of a principal amount and interest (pre-award and post-award interest). They may cover direct losses (e.g. lost tangible or intangible property of the investor) and the loss of anticipated future profits. Past awards range between hundreds of thousands and billions of US dollars. Figure 1 displays a rolling average of monetary damages awarded in treaty-based ISDS proceedings over time. Whereas tribunals ordered on average payment
